1. Who you are contracting with
These Terms govern your use of FitTok (the "Service"), operated by Benjamin Nilsson (sole trader, trading as FitTok, "we", "us"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you confirm you have authority to bind it.
2. The Service
FitTok provides curated fitness content, creator workouts, and supplement information for personal, non-commercial use. The Service is provided on an "as is" basis and we do not guarantee uninterrupted or error-free operation.
Content is for informational purposes only and is not medical advice — consult a qualified professional before starting any training or supplementation program.
3. Accounts
You must provide accurate information, keep your credentials confidential, and are responsible for all activity under your account. You must be of legal age in your jurisdiction to use the Service.
4. Acceptable use
You agree not to:
- use the Service unlawfully or for fraudulent or spam purposes;
- infringe any intellectual property or third-party rights;
- interfere with the security or integrity of the Service (scraping, probing, malware, or circumventing technical limits);
- reverse engineer, resell, or redistribute the Service or its content.
5. Intellectual property
All content, software, branding, and materials forming the Service are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service for the duration of an active subscription.
6. Payments, subscriptions and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. See our Refund Policy for details.
Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel anytime via your account or the customer portal at paddle.net.
7. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. On termination, your access to paid content ends; you may export any personal data within 30 days before deletion.
8. Disclaimers and liability
To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose. Our aggregate liability for any claim is capped at the fees you paid in the 12 months preceding the claim.
We are not liable for indirect, incidental, special, or consequential damages (including loss of profits, data, or goodwill). Nothing in these Terms limits liability for fraud, death, or personal injury where it cannot be excluded by law.
9. Indemnity
You agree to indemnify us against claims arising from your user content, unlawful use of the Service, or breach of these Terms.
10. Changes
We may update these Terms from time to time. Material changes will be communicated via the Service or email. Continued use after changes constitutes acceptance.
11. Governing law
These Terms are governed by the laws of Sweden. Disputes will be resolved in the competent Swedish courts, unless mandatory consumer protection law in your country of residence provides otherwise.
